eGift Card Distribution Terms and Conditions

These eGift Card Distribution Terms and Conditions apply to the creation, distribution, and use of eGift Cards.

  1. General Terms
    JCPenney eGift Cards are distributed by CashStar, Inc., a Delaware corporation ("CashStar"). By visiting this jcpenney.cashstar.com, you agree that the laws of the State of Texas, without regard to principles of conflict of laws, will govern these eGift Card distribution terms and conditions ("Ts & Cs"). CashStar reserves the right to change these Ts & Cs from time to time in its discretion.
  2. JCPenney eGift Card Terms
    JCPenney eGift Cards are issued by J. C. Penney Corporation, Inc. and the following terms apply to their redemption:
    JCPenney eGift Cards are redeemable for merchandise or services (excluding gift cards or eGift Cards) at JCPenney locations in the US and Puerto Rico and online at jcpenney.com. Not redeemable for cash, except where required by law. May not be used to pay on credit accounts.
  3. Purchase Fees
    CashStar will not impose fees of any kind on purchasers or recipients of eGift Cards in connection with the sale of JCPenney eGift Cards.
  4. View Your Balance
    To view your JCPenney eGift Card balance, follow the instructions below your eGift Card, on the page linked from the email message which notified you of your eGift Card. You may also call 1-800-294-8804 or visit www.jcpenney.com to make a balance inquiry.
  5. Returning or Cancelling an eGift Card
    You may not return or cancel your JCPenney eGift Card after it is received. Purchasers who wish to cancel an eGift Card purchase order prior to its delivery to a recipient should contact CashStar Customer Support prior to the delivery date selected during the purchase process.
  6. Lost or Stolen Gift Cards
    If you suspect that someone has copied or stolen your eGift Card, contact CashStar Customer Support immediately. eGift Cards will not be replaced if lost or stolen without the purchaser's confirmation email as proof of purchase. If you provide proper proof of purchase, any remaining balance on your eGift Card can be re-issued to you on a new eGift Card. eGift Cards have cash value and should be safeguarded accordingly.
  7. Limitations
    The maximum value that can be associated with any one JCPenney eGift Card is five hundred dollars ($500.00) and total purchases for any one individual may not exceed ten thousand dollars ($10,000.00) in one calendar day.

    You may not use an eGift Card to purchase other eGift Cards.

    eGift Cards purchased from CashStar cannot be reloaded, resold, transferred for value, or redeemed for cash, except to the extent required by law. Void if reloaded, resold, transferred for value, or redeemed for cash. Unused eGift Cards may not be transferred.
  8. CashStar Policies
    Information that you provide when purchasing an eGift Card is subject to CashStar's Privacy Policy. CashStar and JCPenney may provide JCPenney eGift Card purchasers with information about the redemption status of JCPenney eGift Cards.
  9. Risk of Loss
    Ownership and risk of loss of eGift Cards passes to the purchaser as soon as CashStar sends its confirmation to the recipient. We are not responsible for lost or stolen Gift Cards. If you have any questions, please see the FAQs.
  10. JCPenney eGift Card Customer Service
    If you need assistance with any aspect of your purchase, ownership, or use of your eGift Card, please contact CashStar Customer Support. Please refer to your order number or email address.
  11. Payment Methods
    JCPenney eGift Cards may be paid for with a valid JCPenney Credit Card, VISA, MasterCard, Discover, American Express card or with PayPal.
  12. Delivery Information and Requirements for eGift Card Purchasers
    All orders of eGift Cards are subject to a process that compares purchaser information provided on the web site with information about the purchaser provided by the purchaser's financial institution. If there is a discrepancy, your eGift Card order may be delayed until it can be corrected. If the date on which you want an eGift Card delivered has passed and you have not received confirmation that the eGift Card was sent, please contact CashStar Customer Support. Please refer to your order number or email address. We are not responsible for eGift Cards that are undeliverable or not received due to your failure to enter an accurate email address for the recipient. Please check to make sure the email address of the recipient is correct and contact CashStar Customer Support if you suspect the recipient did not receive his/her eGift Card. Should an email be returned to us due to inaccurate delivery information for the recipient, we will attempt to contact you for a valid email address.
  13. Reasons for Failed Delivery
    If you have confirmed the recipient's email address but the eGift Card has not been viewed within a reasonable period after the requested delivery date, following is a list of the most common reasons why delivery may have failed:
    1. Spam filter blocked email or routed it to a bulk/spam folder
    2. Recipient's firewall blocked the email
    3. Email inbox is over size limit
    4. Invalid email address
    If a spam filter is blocking giftcards@cashstar.com emails from getting to an inbox, the email options will need to be modified so that giftcards@cashstar.com emails are not considered spam.

  14. Personalized Messaging
    If you wish to add a personal message to an eGift Card, simply type your message in the Message field on the Gift Card preview. Personal messages are limited in length to the space provided on the eGift Card. There is no additional charge to include a personalized message. We do not read every gift message, but if we find inappropriate, offensive or otherwise objectionable messages, we reserve the right to cancel them. Thanks for your cooperation.
  15. Uploaded Images
    You may upload your own image for display on an eGift Card. There is no additional charge to include your own image. CashStar reserves the right to cancel any order for an image that it, in its sole discretion, deems potentially unlawful or inappropriate without notice or explanation. We reserve the right to replace images that infringe upon trademark or copyright law. We also reserve the right to replace inappropriate, offensive, or otherwise objectionable images. The following image will appear as a replacement image:

    As part of your eGift Card (also known as electronic gift card) purchase, you (or, if you are under 18 years old, your parent or legal guardian) hereby grant to JCPenney and CashStar and their respective affiliates and agents a nonexclusive, royalty free, worldwide license to use the uploaded image, including all intellectual property rights associated with the uploaded image, to create an eGift Card of the uploaded image (the "License"). You, (or, if you are under 18 years old, your parent or legal guardian) represent and warrant that (1) your grant of the License does not violate the privacy rights, publicity rights, copyrights, trademarks, contract rights or any other rights of any person or entity, (2) if you are uploading a company logo or other copyrighted or trademarked materials, that you are authorized to grant the License to use the uploaded company logo, or copyrighted or trademarked materials to create an eGift Card, and (3) you have full authority and rights to grant the License and to make the representations and warranties contained herein.

    You agree to defend, indemnify and hold CashStar and JCPenney and their respective affiliates harmless from and against all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to a breach of the representations or warranties given by you in connection with your purchase of eGift Cards from this site.
  16. Limitation of Liability
    CASHSTAR AND ITS AFFILIATES, AND JCPENNEY AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EGIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF AN EGIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
  17. Disputes
    You hereby consent that any dispute with CashStar relating to the purchase of JCPenney eGift Cards shall be adjudicated in the United States District Court for the District of Maine, and that any dispute with JCPenney relating to the use of JCPenney eGift Cards shall be adjudicated in the United States District Court for the Northern District of Texas or the District Courts of Collin County, Texas. You herby consent to exclusive jurisdiction and venue in such courts.
